Terms and Conditions

By accessing or using Viewary (the “Platform”), including our website, applications, demos, spatial experiences, and any related services, you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Platform.

These Terms apply to all visitors, registered users, demo participants, and organisations that interact with Viewary in any capacity.

Viewary is provided primarily as a test, preview, and demonstration environment. Projects, municipalities, locations, statistics, comments, AI outputs, imagery, 3D scenes, timelines, and other content shown on the Platform may be fictional, sample, outdated, incomplete, or otherwise not representative of real-world plans, decisions, or official communications.

Nothing on the Platform constitutes a binding public consultation, official government announcement, planning decision, engineering specification, legal advice, or professional recommendation. You must not rely on Platform content for civic, legal, financial, safety, or investment decisions.

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Viewary and its team, affiliates, partners, and contributors disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, accuracy, availability, non-infringement, and uninterrupted or error-free operation.

We do not warrant that spatial streams, uploads, AI summaries, analytics, notifications, or any other feature will be accurate, secure, timely, or suitable for your use case.

To the maximum extent permitted by law, Viewary and its team shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, opportunity, or business interruption, arising out of or related to your access to or use of the Platform, even if we have been advised of the possibility of such damages.

You use the Platform entirely at your own risk. Where liability cannot be excluded, our total aggregate liability for any claim relating to the Platform shall not exceed the amount you paid to Viewary in the twelve (12) months before the event giving rise to the claim, or zero if no payment was made.

If you create an account, you are responsible for keeping your credentials secure and for activity under your account. You agree not to misuse the Platform, attempt unauthorised access, interfere with its operation, submit unlawful content, impersonate others, or use the Platform in a way that could harm Viewary, other users, or third parties.

We may suspend or terminate access at any time, with or without notice, especially where use appears abusive, fraudulent, or inconsistent with the test nature of the Platform.

Comments, questions, suggestions, uploads, and other material you submit may be stored, displayed, analysed, or used to improve the Platform, including for testing AI and participation features. You grant Viewary a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content for Platform operation, demonstration, research, and product development.

You represent that you have the right to submit any content you provide and that it does not violate applicable law or third-party rights.

The Platform may integrate or link to third-party services, identity providers, streaming infrastructure, maps, or external websites. Viewary does not control and is not responsible for third-party services, their availability, or their terms, privacy practices, or content.

We may modify, suspend, or discontinue any part of the Platform at any time without liability. We may also update these Terms from time to time. The “Last updated” date below indicates when these Terms were last revised. Continued use after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws applicable in the Netherlands, without regard to conflict-of-law principles, except where mandatory local consumer protection rules require otherwise.
